MEDICAL AFFIRMATIVE CLAIMS

The U.S. Government has a right to collect for the value of medical care to provided to military members, family members, and retirees by military treatment facilities (MTFs) or TRICARE, for injuries resulting from third party negligence."   

The U.S. Government also has a right to collect for the lost wages of active duty members who are injured and are unable to perform their military duties, including being placed “on quarters”, due to injury and medical treatment.  Recoveries are deposited in the Operations & Maintenance account  of the command or activity that supported the military member at the time of the injury. 

If you have received treatment from a military treatment facility or a facility reimbursed by TRICARE for an injury caused by a third party or covered under a medical pay coverage of an insurance policy, you should contact  the nearest medical affirmative claims office.
