FREEDOM OF INFORMATION ACT (FOIA) OR PRIVACY ACT (PA)

Any individual may submit a FOIA or PA request by mail, facsimile or electronic
mail. |

| Submitting a FOIA Request To submit a request under FOIA, label your request "Freedom of Information Act Request," preferably within the request letter and on the envelope, and address the request to the Military Command or Installation likely to have the information you seek. In your letter you must state your willingness to pay applicable fees. If you seek a fee waiver, provide a justification for such a waiver. To ensure proper processing of your request, describe the specific records you are requesting in sufficient detail so that they can be located with a reasonable amount of effort. Generally, a record is reasonably described when the description contains sufficient file-related information (type of document, title, subject area, date of creation, originator, etc.); or the request contains enough event-related information (date and circumstances surrounding the event the record covers) to permit the conduct of an organized, non-random search. The request must be submitted in writing. No telephone requests will be accepted. |

| Submitting a Privacy Request Right to privacy and access to military records. The Freedom of Information Act (FOIA) and the Privacy Act provide balance between the right of the public to obtain information from military service records, and the right of the veteran to protect his/her privacy. If you are a member of the general public, limited amounts of information can be released to you from an individual's record. If you are the next of kin of a deceased veteran you may, under certain circumstances, be entitled to greater access to the deceased veteran's record than may a member of the public. Specify your relationship to the veteran. You must sufficiently identify the person whose record is requested, so that the record can be located with a reasonable amount of effort. The procedures to release information are based on restrictions imposed by the military services consistent with Department of Defense regulations and the provisions of the Freedom of Information Act and the Privacy Act of 1974. The request must be submitted in writing. No telephone requests will be accepted. |
